Discrimination claims

The mega-retailer is frequently accused of discriminating against some employees, which is one of the most common complaints. Women workers at Wal-Mart have filed a lawsuit, claiming that women were denied promotions and paid less than men for performing the same duties.

Although the US Supreme Court rejected to certify a class-action lawsuit filed by 1.5 million female Wal-Mart employees in that case, the original plaintiff was able to reach a settlement. If an individual employee or group of employees feels that they have been subjected to discrimination on the basis of age, sex, religion, race, nationality, or disability, they can still file a lawsuit against Wal-Mart or another big box retailer, even though it may be challenging to bring a class action workplace discrimination claim against the company.

Employees have recently brought claims of racial, age, gender identity, and sexual orientation discrimination against Wal-Mart in addition to sex discrimination claims. One employee claimed that Wal-Mart would not let her add her same-sex spouse to her Wal-Mart insurance plan, while another claimed that she was harassed and eventually dismissed for being transgender. The facts of these situations are significantly different.

However, a recurring aspect in these claims is that the employees allege that they were subjected to harassment and even discrimination at work because of their affiliation with a specific group. It seems obvious that further lawsuits against Wal-Mart will be filed even though the results of these cases are still uncertain. Wal-Mart, a major employer with almost 2.3 million workers, may not have the greatest policies in place when it comes to combating workplace discrimination, as evidenced by recent cases.

Claims for wage and hour

Over the past ten years, Wal-Mart has also been the target of a number of wage and hour disputes, with one recent case leading to a $224 million decision against the firm. Employees in this Pennsylvania case claimed that depending on how long their shift was, certain breaks were to be paid for according to the Wal-Mart manual.

The workers claimed Wal-Mart owed them money for failing to reimburse them for the promised breaks and filed a lawsuit under the Fair Labor Standards Act. The roughly 187,000 employees received a total payout of $188 million when the judge sided with the workers. The United States Supreme Court declined to hear the appeal from Wal-Mart. The employees will now receive $224 million in compensation with interest.
